  • Any projects or work in the five boroughs of New York City (Manhattan, Brooklyn, Queens, Staten Island, Bronx)
  • Existing work or operations such as remodeling or structural alterations project to the following:
    • Hospitals
    • Prisons
    • Student housing or dormitories
  • Renovation or remodeling in a habitational building related to structural work
  • Underground construction, such as subways or mines
  • Underwater construction including boats and floating platforms
  • New ventures with less than three years of business and operating experience
  • Any new or existing work in the following industries:
    • Refineries or oil field operations
    • Drilling operations
    • Chemical Plants
    • Mills
    • Grain Elevators
  • Use of Explosives or Fireworks
  • Hazardous chemicals or asbestos
  • Any project without Job Site Safety Program
  • Uninsured contractors
  • Any risks with the following exposure to Mold, Silica, and nuclear incident
  • Any project or repair works related to tunnel, dams, ports, and waterways (except bridge over the waterway)
UNDERWRITING REFERRALS:
  • Risks with an annual job cost in excess of $50,000,000
  • New construction of any buildings greater than six (6) stories and annual cost in excess of $50,000,000
  • Any NY road & street, highway, and bridge projects over $25,000,000
  • Any project with an annual job cost exceeding $10,000,000 in Erie County (Buffalo area) or Nassau County (Long Island)
  • Any request limit over $5,000,000
  • Exterior building maintenance or scaffolding over three (3) stories
  • Risks with project term greater than 36 months
  • Any risk requesting CG 2414 – Waiver of Governmental Immunity
  • Any risk requesting the removal of unmanned aircraft exclusion
Railroad Protection Liability:
Available in all states with the exception of Alaska and Hawaii.

Each policy should be written for the term of the contract.  There are no renewal policies issued through the program.
Information Required:
  • Type of project
  • Total contract cost and the amount of the cost of that contract that is within 50 feet of the railroad right of way
  • Length of overhead wire/lines or underground pipe if the work is parallel to the tracks.
  • Daily number of trains
Other Requirements:

Contractor with at least one year of experience

The following exposures will be referred to Westchester Fire Insurance Company as long as the following three questions are answered "yes" on the application:
  1. Will a project contract, including a hold harmless agreement, be signed by the designated contractor?
  2. Will the railroad be named as an additional insured on the contractor’s GL policy?
  3. Will the contractual exclusion for the work within 50 feet of the railroad property be deleted on the contractor’s general liability and umbrella policies?
Exposures:
  • Use of explosives or fireworks
  • Underground construction such as subways, tunnels or mines
  • Work in existing: refineries, chemical plants, mills, or grain elevators
  • Hazardous chemicals
  • Underwater construction
  • Track work with daily trains running
  • Limits other than 1/3, 2/4, 2/6, 3/6 or 5/10
RRP’s with contract costs greater than $5,000,000 within 50 feet of the railroad right of way must be referred to carrier prior to quoting

RRP’s with bridge work and a requested limit of 5mm/10mm must be referred to the carrier prior to quoting

Projects in which railroad employees except flagmen or supervisors have been assigned must be referred to the carrier prior to quoting

RRP’s with new construction within 50 feet of the railroad right of way must be referred to the carrier prior to binding
Project Specific Contractor's Pollution Liability:
Available in all states except AK and HI.
Other Requirements:
Contracting firm must be in business at least 3 years.

Contract amount up to 50M.

There is no back dating of coverage. Policies are 100% minimum earned.

Additional Insured and Waiver of Subrogation are automatically included when required by written contract.

This is a risk purchasing group. There is NO SHARING of limits and the limit will apply separately to each certificate. Coverage is issued on Admitted Paper by Greenwich Insurance Company (part of XL Group Ltd) rated A XV by A.M. Best Co.
Annual Renewable Contractor's Pollution Liability:
  • Available in all states except AK and HI.
  • Contract amount up to 50M (any contract amount over 50M will be a referral).
  • The program only covers Commercial Construction and will have a residential construction exclusion. The program is available to a commercial contractor who might have a small percentage of residential work; however, that residential work will not be covered. When showing revenue on the application exclude any residential revenue.
  • There is no back dating of coverage. Policies are 25% minimum earned.
  • Additional insured and mold coverage are automatic in the policy form. If work is performed in hospitals the mold coverage will be on a claims made basis only.
